Do not apply for both the automatic 6-month extension and the additional 3-month extension at the same time. An organization will only be allowed an extension of 6 months for a return for a tax year. Note that Form 8868 cannot be filed to extend the due date of a Form 990-N. Extending the time for filing a return does not extend the time for paying tax. Extra Time to File Doesn’t Mean Extra Time to Pay, April 17 is the last date and use ExtensionTax.com

An extension will give you extra time to file your return, but any tax is still due by the original deadline. An extension can help reduce penalties, but any outstanding balance will still be charged a late payment penalty (0.5 percent per month) and interest (right now at 3 percent annually).

When to File Extension Tax Form 7004

Generally, Form 7004 must be filed on or before the due date of the applicable tax return. The due dates of the returns can be found here for the applicable return.

File a separate Form 7004 for each return for which you are requesting an extension of time to file. This extension will apply only to the specific return identified by its line number.

Example: A taxpayer who needs to file Forms 7004 for multiple form types may submit the Forms 7004 electronically. For example, taxpayers submitting one Form 7004 with “Type of Return Code” 31 for the Form 8804 and another Form 7004 with “Type of Return Code” 09 for the Form 1065 may file the Forms electronically. But the taxpayer may submit only one Form 7004 for each form type. So if the taxpayer files two Forms 7004 for “Type of Return Code” 09, the second Form 7004 will reject as a duplicate.

Extension Tax Form 7004 is Due this March 15

Form 7004 is the form used to file for an automatic extension of time to file your business tax returns for a partnership, a multiple member LLC filing as a partnership, a corporation, or s-corporation. You must file this extension by the due date of your business tax return. This is an automatic extension, so you will eligible for 6-months automatic extension of time to report your business return, however this automatic extension of time is just for report and not applicable for payment of tax bill.

Due Dates for Returns and Extension Applications

The due date for partnership and multiple-member LLC tax returns has changed. Partnership tax returns are now due on the 15th day of the third month after the end of your fiscal (financial) year. Since your partnership must end on December 31, the due date is March 15.

Tax return due dates vary by year. Extension applications for all business taxes must be filed by the tax return due date and taxes must be paid by the due date, even if an extension application is being filed. The taxes due must be estimated and the balance paid at the time the return is filed.

S corporation tax returns: S corporations must take a December 31 year-end to coincide with the tax return due date of the owners, so S corporation tax returns are due March 15, filed on Form 1120-S.

What’s New in Form 8868?

There is now an automatic 6-month extension of time to file instead of the previous 3-month automatic extension and subsequent request for an additional 3-month extension. The form and instructions have been revised accordingly.

If an organization has not filed the required Form 990 series for three consecutive years, and if the due date (or extended due date) of the third year’s filing has passed, the tax-exempt status will be revoked to the original filing date.
